ROBERTO “BOBBY” Sacay, proprietor of Chiebob’s Corner who has filed a complaint of graft and corruption against Mayor Eric Codilla, city administrator Dennis Y. Capuyan and Superdome manager Simon Albino Racaza, has filed his reply to the counter-affidavits of the three.
It was reported last week that the three have already filed their counter-affidavits and claimed there was nothing political in their move to close down Sacay’s resto-bar at the Superdome. They also debunked certifications from Sacay’s neighbors that they had no complaint against him with regards sanitation, saying these were immaterial.
They also claimed that Sacay misled the Ombudsman to believe that his contract for the space was for three years, when it actually expired on the period they stopped him from his operations.
In his reply, Sacay said that the counter-affidavits of the three amplified his complaints in the sense that they “admitted” having “unilaterally revoked the Contract of Lease” without giving him due process.
He also pointed out that the minutes of the Economic Enterprise committee attached to the counters show that they only received “a report regarding the comfort room where the customer’s of Chiebob’s corner were allowed to use only on April 12, 2010 which was almost two (2) months from the time Respondent Capuyan unilaterally revoked the Lease Contract”.
Sacay also pointed out that Racaza himself admits in his affidavit have disconnected the electricity of Chiebob’s Corner.
As for the issue that the contract was only for one year, he said “the Ormoc City Treasurer’s Office continued to send billings for the months of April, May and June 2010 and herein Complainant religiously paid the monthly rental fee”.
Sacay also stressed that “Contrary to the allegations of the Respondents, herein Complainant did not violate any provision of the Contract of Lease. Herein Complainant reiterates the fact that there was no condition set in the Contract of Lease that he will be responsible for the upkeep of the comfort room of the Ormoc City Superdome. It is the responsibility of Respondent – Racaza to maintain and clean the comfort rooms and other common areas of the Ormoc City Superdome, being the Administrator thereof. In addition, herein Complainant did not receive any Notice of Violation from Respondent – Codilla pertaining to the alleged construction of illegal structures”.
As for his blood ties to Racaza, Sacay had this to say, “Racaza is a relative by affinity” and Mr. Gaspar Sacay a relative. “However it does not change the fact that only the mother of the complainant chose to side with the opposition” to the incumbent mayor.
He ended by saying that the act of closing his store has caused him “undue injury, business losses and financial distress”. By Lalaine M. Jimenea
